Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MyAisle website, mobile app, merchant dashboard, and operator portal (collectively, the "Service"), operated by MyAisle by Tunez Technologies INC. ("MyAisle", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old and able to form a binding contract. Merchant and operator accounts must be created by an authorized representative of the business.

2. Account

You are responsible for safeguarding your credentials and for any activity that occurs under your account. Notify us immediately at support@myaisle.app if you suspect unauthorized access.

3. Acceptable use

You agree not to misuse the Service. See our Acceptable Use Policy for specifics.

4. Shoppers

• Orders, reservations, and pickups are contracts between you and the participating merchant. MyAisle facilitates the transaction.
• A service fee may apply at checkout and will be itemized before you confirm.
• Optional add-ons (e.g., MyAisle TryOn+) are billed separately and disclosed in-app.

5. Merchants and operators

• You retain ownership of your catalog, store, and property data. You grant MyAisle a non-exclusive license to host, display, and process that data to provide the Service.
• Subscription fees, billing cycle, and feature tiers are described on the Pricing page.
• You are responsible for the accuracy of inventory, pricing, lease, and fulfillment information.

6. Fees and payment

Paid plans renew automatically until canceled. You can cancel from your dashboard. Fees already incurred are non-refundable except where required by law.

7. Intellectual property

The Service, including its software, branding, and content, is owned by MyAisle by Tunez Technologies INC. and protected by intellectual property laws. You may not copy, modify, or reverse engineer the Service.

8. Termination

You can close your account at any time. We may suspend or terminate accounts that violate these Terms or applicable law.

9. Disclaimers

The Service is provided "as is" and "as available." MyAisle disclaims, to the maximum extent permitted by law, all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, MyAisle by Tunez Technologies INC. is not liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability will not exceed the greater of (a) the amount you paid us in the prior twelve months or (b) USD 100.

11. Indemnification

You agree to indemnify MyAisle against claims arising from your use of the Service or violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware.

13. Changes

We may update these Terms. Material changes will be announced in-app or by email and become effective on the date posted.
